Have confidence in any IR35 Status Determination

The Insurance Validation Tool (IVT) is essentially a lite version of the full Kingsbridge IR35 Status Tool that’s designed to quickly check an external IR35 status determination – from CEST, for example – for accuracy within 10 short questions. This grants you access to Kingsbridge IR35 Protect insurance for your contractors without needing to complete a full IR35 assessment for them again if you’ve already gotten an SDS elsewhere, ensuring you are compliant as quickly and conveniently as possible.

Our prospects of success will be met by using the Insurance Validation Tool without you having to carry out a new assessment, saving time and resource while still fully meeting your IR35 compliance obligations. You can still purchase IR35 or Off-Payroll Protect without our prospects of success having been met, but this will be reflected in the cover detailed in the policy wording.

We'll help you remain IR35 compliant by sending all IR35 policy documents - should a contractor purchase insurance - directly to you to help satisfy your compliance process and maintain your records.

Holding PI insurance acts as a great indicator of the contractor being outside of IR35, as they’re effectively demonstrating that their limited company carries a financial risk – something a typical employee does not have to worry about.

While you can still take out IR35 and Off-Payroll Protect insurance without this, you would still be subject to our prospects of success clause in the event of an IR35 investigation. The Insurance Validation Tool grants you access to the full Kingsbridge IR35 Protect insurance with the prospects of success obligations met for your contractors without needing to complete a full IR35 assessment for them again if you’ve already obtained an SDS elsewhere, keeping you compliant as quickly and conveniently as possible.

PI Elsewhere

Simply put, if you have IR35 Secure turned on, we will collect the renewal date and current insurance provider of your contractors’ Professional Indemnity insurance. This allows us to support you in making sure the contractor is holding the right insurance cover for their limited company.

While it’s not a legal requirement, there are many benefits to making sure your contractors hold PI and IR35 insurances. Not only does it help to place contractors if clients know they can cover a claim should any mistakes be made, but it’s also a great indicator that the contractor is operating outside IR35.

Please note that this will only be accessible if you have IR35 Secure turned on within the tool.

Terms of use

We’re making a couple of small updates to the existing terms of use for the IR35 Status Tool. We’re not adding anything in, but rather amending the wording of the existing terms you’ll have accepted upon signing up to use the tool. These changes are to:

  • Make it clearer how you, your staff, and your clients should be using the tool to get the very most out of it; and
  • Better protect all parties using the tool.

The new terms will be replacing the T&Cs (available here: https://www.ir35.io/terms.pdf), and will apply to anyone logging into the partner version of the IR35 Tool.

Client portal

We’ve also been working on the tool user interface to make your customer journey smoother and more efficient.

We’ve recognised the need for a simple self-service for clients, so we’ve built a feature to provide your Client Admin with the ability to easily filter between the SDS User and the Standard users in your company portal.

As well as still being able to set up users, the client admin will now be able to:

  • Send a reset password email to a user using the ‘Reset’ option;
  • Delete a user using the ‘Delete’ option;
  • Change an email address; and
  • Correct a first name or surname.

Updates to question wordings

Another update to wording, this time within the tool itself, is around the questions we ask contractors to be able to assess their IR35 status. We’ve made some small changes to the way we talk about contractors and their limited companies to be as compliant as possible.

These amends are material on the whole, and won’t change either the core meaning of the questions we’re asking or the accuracy of our IR35 status results. We can supply a full summary of question wording changes ahead of the release if you so wish.
